ARTICLE 1. Definitions
Personal data Any information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”); an “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.
Processing Any operation or set of operations performed, whether or not by automated means, on data or sets of personal data, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
Filing system Any structured set of personal data accessible according to specific criteria, whether centralised, decentralised or dispersed on a functional or geographical basis.
Controller The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing.
Processor The natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
Recipient The natural or legal person, public authority, agency or any other body to which personal data are disclosed, whether a third party or not.
ARTICLE 2. Data collected by Seine en Bateaux
The data controller is Marie-Line NAUDIN – Seine-en-Bateaux – BELANA CROISIERES SARL – 27 bd Saint-Martin – 75 003 PARIS – France, represented by its manager Marie-Line NAUDIN. The data collected by Seine-en-Bateaux are either mandatory or optional. This is indicated in each form by the presence of an asterisk. In accordance with Article 6-II of the Act on Confidence in the Digital Economy no. 2004-575 of 21 June 2004 and its implementing decree no. 2011-219 of 25 February 2011, Seine-en-Bateaux collects identification data. Seine-en-Bateaux collects data relating to your browsing on the site and your behaviour (number of pages viewed, pages viewed, IP address, etc.). ARTICLE 3. Legal basis for the processing of personal data
3.1. Processing necessary for the performance of the contract In order to enable you to access the various services offered by Seine-en-Bateaux, you have accepted general terms of use and general terms and conditions of sale. It is these documents that formalise your contractual relationship with Seine-en-Bateaux and that constitute the legal basis for the processing of personal data by Seine-en-Bateaux. The data collected are necessary for the performance of this contract.
3.2. Processing based on the law Pursuant to decree no. 2011-219 of 25 February 2011, Seine-en-Bateaux must retain the data enabling the identification of any person who has contributed to the creation of content published online (reviews, ratings, comments).
3.3. Processing based on consent The data relating to the sending of promotional emails (newsletters) are based on your consent (opt-in) with regard to Users. You have the option of unsubscribing at any time by clicking on the “unsubscribe” link present in all promotional emails sent by Seine-en-Bateaux. Seine-en-Bateaux has a legitimate interest in processing your personal data in order to ensure, for example, your authentication or for the purposes of fraud prevention. You have the option of objecting to certain processing operations, such as those concerning cookies, by expressing your choice. Seine-en-Bateaux ensures that it does not disregard your interest and that this does not infringe upon your privacy.
ARTICLE 4. Purposes pursued
The data are collected for the following purposes: • For users: • Registration • Management of requests to exercise rights relating to personal data • Combating fraud • Sale of products • Management of unpaid invoices • More specifically, with regard to cookies, these allow: the implementation of security measures • The establishment of statistics and volumes of traffic and use of our website and its various pages • The counting of the number of displays, the identification of content and the determination of the number of people who have clicked on each item of content • The adaptation of the presentation of our site to your device
ARTICLE 5. Retention periods
The data concerning the sending of promotional emails are retained for a period of three (3) years from your last activity on the web platform, including the sending of an email. Audience-measurement statistics and traffic data are retained for a period of THIRTEEN (13) months in accordance with the law. The data relating to online reviews and ratings are retained for 3 years. The data relating to your browsing and/or your behaviour on the Seine-en-Bateaux website, and those concerning your profile as declared/completed by you, are retained for THREE (3) years from your last activity on the web platform. The data concerning identity documents relating to the exercise of the rights of access, rectification, deletion, restriction, erasure and portability are retained for ONE (1) year from their receipt. At the end of the relationship between Seine-en-Bateaux and yourself, the data will then be the subject of intermediate archiving in order to comply with tax and accounting obligations (Article L. 123-22, second paragraph, of the Commercial Code – TEN (10) years) or legal obligations such as the period of FIVE (5) years, which is the limitation period applicable to personal or movable-property actions (Article 2224 of the Civil Code). In the event of legal proceedings, the personal data concerning you will be retained so as to enable Seine-en-Bateaux to ensure its defence or to enable it to establish the facts should Seine-en-Bateaux be the claimant.
ARTICLE 6. Information shared with third parties
In order to be able to provide you with certain services, Seine-en-Bateaux communicates certain of your personal data that are strictly necessary to its partners. • Payment service providers • Customer relationship management (CRM) • Web analytics for the analysis of audience on the site • Hosting providers • IT providers and webmaster • The accountancy firm
Seine-en-Bateaux may be required to communicate your data to the judicial authorities upon injunction. In any event, Seine-en-Bateaux will never transmit your personal data to third parties without your consent. The partners/processors of Seine-en-Bateaux process your personal data on behalf of and in accordance with the instructions of Seine-en-Bateaux, complying with this Privacy Policy as well as with the security and confidentiality measures necessary for the protection of your personal data.
ARTICLE 7. Data hosting
Personal data are hosted in France on secure servers and within the European Union. In order to provide you with certain services, Seine-en-Bateaux may be required to transfer certain data outside the European Union. Seine-en-Bateaux will take every security and confidentiality measure to secure the transfer of these data and their receipt. Seine-en-Bateaux requires by contract that the processors concerned take appropriate technical and organisational measures, in particular by providing for clauses compliant with the GDPR and with the recommendations of the European Commission.
ARTICLE 8. Your Rights
8.1. Right of access You have the right to obtain from Seine-en-Bateaux confirmation as to whether or not personal data concerning you are being processed. Where the data are being processed, you have a right of access to those data and to the following information: • a) the purposes of the processing; • b) the categories of personal data concerned; • c) the recipients or categories of recipient to whom the data have been or will be disclosed; • d) where possible, the envisaged retention period of the data or, where this is not possible, the criteria used to determine that period; • e) the existence of the right to request from Seine-en-Bateaux the rectification or erasure of the data, or a restriction of the processing, or to object to the processing; • f) the right to lodge a complaint with the CNIL; • g) where the personal data are not collected directly from you, any available information as to their source; • h) the existence of automated decision-making, including profiling, and, at least in such cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for you. • Furthermore, where personal data are transferred to a third country or to an international organisation, you have the right to be informed of the appropriate safeguards relating to the transfer.
Seine-en-Bateaux will provide you with a copy of the data undergoing processing. Seine-en-Bateaux may charge a reasonable fee based on administrative costs for any further copies you request. If you request a copy of the data by electronic means, Seine-en-Bateaux will provide them in a commonly used electronic form, unless you request otherwise. Finally, the right to obtain a copy of the personal data shall not adversely affect the rights and freedoms of others.
8.2. Right to rectification You have the option of requesting that Seine-en-Bateaux rectify, as soon as possible, any data concerning you that may be inaccurate. You also have the option of having incomplete personal data concerning you completed, including by providing a supplementary statement.
8.3. Right to erasure You have the right to the erasure of your personal data as soon as possible where one of the following grounds applies: • a) The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; • b) You withdraw the consent on which the processing is based, and there is no other legal ground for the processing concerned. The withdrawal of consent applies for the future;
• c) You exercise your right to object and there are no overriding legitimate grounds for the processing;
• d) The personal data have been unlawfully processed; • e) The personal data must be erased to comply with a legal obligation. • You are informed that the right to erasure may not apply where processing is necessary to comply with a legal obligation, or for the establishment, exercise or defence of legal claims.
8.4. Right to restriction of processing You have the option of requesting the restriction of the processing of your personal data where one of the following applies: • a) Verification of your data following a challenge by you as to the accuracy of your personal data; • b) The processing is unlawful and you oppose the erasure of your personal data and request instead the restriction of their use; • c) Seine-en-Bateaux no longer needs the personal data concerning you for the processing, but the data are required by you for the establishment, exercise or defence of legal claims; • d) You have objected to the processing and Seine-en-Bateaux is verifying whether its legitimate grounds override your own.
8.5. Right to portability You have the option of receiving the personal data you have provided to Seine-en-Bateaux in a structured, commonly used and machine-readable format where: • a) The processing is based on consent or on a contract; • b) and the processing is carried out by automated means. In exercising this right, you have the right to have your personal data transmitted directly from Seine-en-Bateaux to another controller where technically feasible. The right to portability shall not adversely affect the rights and freedoms of third parties.
8.6. Right to object Pursuant to the right to object, you have the right to object at any time, on grounds relating to your particular situation, to processing of personal data based on the legitimate interests of Seine-en-Bateaux. Seine-en-Bateaux will no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims. In addition, for personal data processed for direct-marketing purposes, you have the right to object at any time. 8.7. Treatment of personal data after death Pursuant to the law, you have the option of defining your directives concerning the retention, erasure and communication of your personal data in the event of your death. You may communicate your directives to us or register them with a certified digital trusted third party. You may therefore designate the person of your choice who will be responsible for carrying out your directives. Failing that, this will be your heirs.

9.1. 9.2. Response time Seine-en-Bateaux has a period of one (1) month to respond to you from the receipt of your request. This period may be extended by two months in view of the complexity and number of requests. Seine-en-Bateaux will inform the person within the month of their request.
In the event that you exercise your right to deletion or your right to erasure, you are informed that Seine-en-Bateaux may be required to retain the personal data concerning you in the form of archiving prior to deletion, for the relevant period. Concerning newsletters and promotional offers, you have the option of unsubscribing at any time by clicking on the hyperlink available in each of the emails sent by Seine-en-Bateaux. You also have the right to lodge a complaint with the CNIL, the supervisory authority (www.cnil.fr).
